China establishes legal system for human resources development

China has established a legal system for human resources development with the Constitution as the essential basis, said a white paper titled "China's Human Resources" issued on Friday.

The white paper, issued by the Information Office of the State Council, said the legal system is based on the Labor Law and the Civil Servant Law. The system also consists of the Labor Contract Law, the Employment Promotion Law, and the Law on Mediation and Arbitration of Labor Disputes.

Other laws and administrative regulations through scientific and democratic legislation also contribute to the legal system for all citizens to enjoy fair rights of development, it said.

To promote employment, China promulgated the Labor Law in 1994 which expressly states that the government should strive to create job opportunities and expand employment through promoting economic and social development.

In addition, China passed the Employment Promotion Law in 2007 and laid down the principle of "independent job-seeking by workers, employment based on market forces and the promotion of employment by the government."

The white paper said China ensures that workers enjoy the rights of equal employment and independent job-seeking in accordance with a series of laws.

Since 1988, China has promulgated the Law for the Protection of Disabled Persons, Law for the Protection of Women's Rights and Interests, Law for the Protection of Minors, Regulations Concerning the Labor Protection of Female Staff and Workers, Provisions Concerning the Prohibition of the Use of Child Labor, Regulations on the Employment of the Disabled, and other laws and administrative regulations.

The state also promotes vocational education and training through legislation, the white paper said.

Since 1995, China has promulgated the Education Law, Vocational Education Law, Law on Promotion of Privately-run Schools and similar laws, and has established a vocational education and training mechanism under the principle of "market-oriented training, and training to promote employment," the white paper said.

To provide better management and service for individuals with professional skills and abilities, China has promulgated the Teachers Law, Law on Medical Practitioners, Law on Lawyers, Law on Certified Public Accountants, Regulations on Certified Public Architects, and other related laws and regulations since 1993.

These laws and regulations have standardized the employment requirements for professional and technical personnel and improved the quality of professional services, the white paper said.
