National People's Congress
As stated in the Constitution of the People's Republic of China (PRC), the National People's Congress (NPC) of the PRC is the highest organ of state power. The permanent body of the NPC is its Standing Committee.
The NPC and its Standing Committee uphold the leadership of the CPC and exercise their functions and powers in accordance with the Constitution and the law.
The NPC is constituted through democratic election and is responsible to the people and subject to their supervision. The NPC and its Standing Committee promote whole-process people's democracy, maintain close ties with the people, respect public opinions and suggestions, reflect the people's will, and protect their rights and interests. The NPC and its Standing Committee exercise the legislative power of the state, decide on major issues, supervise the enforcement of the Constitution and the law, and safeguard the unity, sanctity, and authority of the socialist legal system in order to build a socialist country under the rule of law. They apply the principle of democratic centralism, give full play to democracy, and exercise their functions and powers collectively. They are active in holding external activities and conducting exchanges and cooperation with the parliaments of other countries and international and regional organizations of parliaments.
The NPC is elected for a term of five years. It meets in session once a year and is convened by its Standing Committee. A session of the NPC may be convened at any time the Standing Committee deems it necessary or when more than one-fifth of the deputies to the NPC so propose.
全國人民代表大會
《中華人民共和國憲法》規(guī)定，中華人民共和國全國人民代表大會是最高國家權(quán)力機關(guān)，其常設(shè)機關(guān)是全國人民代表大會常務(wù)委員會。
全國人民代表大會及其常務(wù)委員會堅持中國共產(chǎn)黨的領(lǐng)導(dǎo)，依照憲法和法律規(guī)定行使職權(quán)。全國人民代表大會由民主選舉產(chǎn)生，對人民負責(zé)，受人民監(jiān)督。全國人民代表大會及其常務(wù)委員會堅持全過程人民民主，始終同人民保持密切聯(lián)系，傾聽人民的意見和建議，體現(xiàn)人民意志，保障人民權(quán)益。全國人民代表大會及其常務(wù)委員會行使國家立法權(quán)，決定重大事項，監(jiān)督憲法和法律的實施，維護社會主義法制的統(tǒng)一、尊嚴、權(quán)威，建設(shè)社會主義法治國家。全國人民代表大會及其常務(wù)委員會實行民主集中制原則，充分發(fā)揚民主，集體行使職權(quán)。全國人民代表大會及其常務(wù)委員會積極開展對外交往，加強同各國議會、國際和地區(qū)議會組織的交流與合作。
全國人民代表大會每屆任期五年。全國人民代表大會會議每年舉行一次，由全國人民代表大會常務(wù)委員會召集。全國人民代表大會常務(wù)委員會認為必要，或者有五分之一以上的全國人民代表大會代表提議，可以臨時召集全國人民代表大會會議。
